Status, costs and revenues: what to anticipate


A real estate advisor iad exercises as independent commercial agent, under cover of his principal's professional card. Here are the concrete points to know before you commit.

Registration

You must be registered in the Special Register of Commercial Agents (SRAC). Since 1stir January 2023, the application is made online on the Business formalities window, and no longer directly with the transplant. The formality must be carried out within 15 days of the start of the activity; its published cost is 23,21 € for an individual enterprise or micro-enterprise.

The clearance certificate

You do not hold the professional card: you exercise under cover of that of your principal, materialized by a certificate of authorisation the Chamber of Commerce and Industry. It is requested by the cardholder, and its expiry date cannot exceed that of the card.

Insurance and incompatibilities

One professional liability insurance is compulsory. The Hoguet Act also strictly regulates the activity: you cannot receive or hold funds, nor give legal advice, nor direct an institution or agency.

Continuing training

Continuing training is fixed at 14 hours a year, or 42 hours over three consecutive years Exercise. It is this second formulation that is generally used at the time of renewal of the authorization.

Fees and remuneration

The activity involves a monthly subscription and regular professional fees (insurance, travel, tools, communication). In return, the share of the fees paid to the adviser is significantly higher than that of an agency employee, with increments ranging from 69 % to 85 % of the fees according to annual turnover, under the applicable iad contractual conditions.

Income depends on transactions actually made and received. Their level and regularity vary according to the sector, business activity, experience and time to sell. No amount is guaranteed, and a transaction is paid only after it has actually been carried out — hence the importance of cash flow before you start.

Do you need a degree or a real estate experience?

No real estate degree is required to practise as a licensed commercial agent. Business, relational or entrepreneurial skills are useful, but training and implementation remain essential.

Can we start in parallel with another activity?

This depends on your employment contract, your actual availability and the rules applicable to your situation. These dots must be checked before starting, not after.

How long before you get income?

There is no guaranteed time limit. A transaction consists of several stages — mandate, offer, compromise, financing, act — and is paid only after it has been completed. Therefore, a transitional cash flow must be provided that is appropriate to your situation.

What administrative steps should be taken?

Registration in the Special Register of Commercial Agents is done online on the Business Formalities Window, within 15 days of the start of the activity, for a published cost of € 23,21.
